It is not widely known but about 300,000 people have a claim for about £60,000 each (or whatever has been spent on care home fees), if the primary reason for them being in a care home was health related. It all flows from a case of Coughlan in 1999.
In that case the learner Judge held that if the primary reaosn for nursing care is health related then it is a taxable benefit and should be paid for by the PCT/Local authority because that person has, in theiry, paid tax all their life. If the hospital can't provide the bed then the local authority needs to make other plans.
